Terms and Conditions of Sale
1. All items are
sold WHERE IS & AS IS! The auctioneer makes no warranty, express or implies as to
size, count weight, style, authenticity, period material or manufacturer, or any other
warranty except as specified below.
2. The catalog lists
are a courtesy, meant as a descriptive guide only. The buyer is cautioned to use the
preview to examine all merchandise and to use his/her best judgment as to whether or not
the descriptions and categories are accurate.
3. Title transfers
to the customer at the fall of the hammer subject to the provisions above. From the moment
the auctioneer will accept no returns excepted. Please be sure you are bidding on the
correct item and have examined it carefully before placing a bid!
4. The auctioneer
reserved the right to refuse any and all bids, at his sole discretion, whether or not a
reserve is in place, and will be the sole arbiter in any dispute. The auctioneer may, if
he chooses, re-offer a disputed lot.
5. Bids which are
submitted to Stamford Auction Gallery in writing prior to auction for execution at or
below a specified price (Order and telephone bids) shall be entertained and executed for
the convenience of bidders not present at the auction and Stamford Auction Gallery will
not be responsible for failing to execute such bids or for errors relating to the
execution of such bids. Minimum bid amount to reserve a telephone line is $200.
6. A buyers
premium of 20% will be applied to the purchase price of all items except those purchased
through the internet services of Ebay Live Auctions. A buyers premium of 22.5% will be
applied to those lots. If you are bidding on Ebay Live Auctions, please be prepared to bid
quickly.
7. Purchases must be
removed from the gallery within ten business days following the date of the sale, or they
become subject to a storage fee of $10.00 per item per day. Stamford Auction Gallery will
not be held responsible for loss or damage to items left on premises over three business
days.
8. We must impose a
service charge of $20.00 on any returned check.
9. All payment,
shipping or pickup arrangements MUST be made within four days of auction date.
10. All purchases
are subject to 6% Connecticut sales tax. Sales tax numbers from other states are accepted,
but the resale tax form must be fully and completely filled out and received prior to time
of purchase.
11. All purchases
will be in U.S. Dollars. Acceptable methods of payment are: Cash, Check, or Wire Transfer.
Visa/MasterCard is also accepted. We reserve the right to hold all goods paid for by
check, money order or wire transfer until payment has cleared.
12. Condition
reports are statements of opinion by the staff of Stamford Auction. It is not a warrantee.
If you would like a condition report for items in the sale, please call us week of sale.
Stamford Auction is not liable or responsible for any errors in the condition report or
failure to deliver the same.
13. All property
must be paid for within 5 business days. Shipping arrangements must be made within 10
business days. Property paid for with checks will not be released until checks clear.
All property must be removed within 10 days of purchase or items
will be moved to third-party storage at buyer's expense.
IN REGARD TO
SHIPPING: Stamford Auction Gallery is NOT responsible for shipping. All shipping is to be
arranged and paid for by the successful bidder. Stamford Auction Gallery will direct
successful bidders to shipping agents , or successful bidders may make their own
arrangements for pick-up and delivery of property.
